1.1. Brand Ownership: Besary (https://besary.com) is a registered brand operating as an authorized sub-seller for Zambeel. 1.2. Relationship Disclosure: All products, trademarks, and inventory associated with the Besary storefront are sourced and authorized through the partnership with Zambeel. By purchasing from Besary, you acknowledge that the underlying product warranties or manufacturer-level liabilities may be governed by the primary agreements held by Zambeel. 1.3. Limited Liability: Besary acts as a retail interface. Any claims regarding mass-product defects or manufacturer recalls may be redirected to Zambeel as the primary supplier, though Besary remains your point of contact for the 14-day return/exchange window.

As per the law of Shariaa, we don’t actually always own the product until you buy it, and we have to be clear about it as per the Shariaa law. It doesn’t affect your pricing, your policies, but you always need to be noticed and learnt about.

12. INTELLECTUAL PROPERTY (Updated)

12.1. All trademarks, logos, and service marks displayed on the Site are the property of Besary, its parent entity Zambeel, or their respective third-party partners. 12.2. The arrangement, “look and feel,” and proprietary imagery of the Site are protected under UAE Intellectual Property Law. No license is granted to any User to use these marks without express written consent from the relevant brand owner.

ADVERTISING & MARKETING POLICY

This Advertising Policy (“Policy”) outlines the standards and guidelines for all promotional content, advertisements, and marketing communications issued by or on behalf of Besary (https://besary.com). This policy is managed in coordination with our marketing partner, Udjat UAE, and our technical partner, Brightery.

1. LEGAL COMPLIANCE & AUTHORIZATION

1.1. UAE Media Standards: All advertisements for Besary must comply with the Federal Decree-Law No. (55) of 2022 on the Regulation of Media. Content must respect the religious, cultural, and social values of the United Arab Emirates. 1.2. Sub-Seller Status: As an authorized sub-seller for Zambeel, Besary is authorized to utilize brand assets, product descriptions, and media provided by Zambeel. Any unauthorized use of these assets by third parties is strictly prohibited. 1.3. Truth in Advertising: We adhere to a strict policy of “Zero Misleading Information.” All product claims, technical specifications, and performance data must be verifiable.

2. PRICING & PROMOTIONAL OFFERS

2.1. Price Transparency: Advertised prices are shown in AED. While we strive for accuracy, any pricing errors in digital ads (including social media carousels or search engine results) do not constitute a binding contract. Besary reserves the right to cancel orders based on technical pricing glitches. 2.2. Limited-Time Offers: All promotional countdowns or “flash sales” are subject to stock availability. 2.3. The 14-Day Rule: All advertisements implicitly or explicitly fall under the Besary 14-day return and exchange policy. No marketing campaign may override this 14-day window unless it offers a longer period for specific seasonal promotions.

3. THIRD-PARTY PLATFORM DATA (Meta, Google, TikTok)

3.1. Data Privacy: Our advertising tracking (pixels, cookies) is managed to ensure compliance with UAE data protection standards. 3.2. Technical Implementation: All tracking scripts and marketing API integrations are maintained by Brightery. Any technical disputes regarding ad-tracking or data leaks should be directed to Brightery (https://brightery.com). 3.3. Opt-Out: Users have the right to opt-out of targeted advertising through their browser settings or platform-specific ad preferences.

4. INFLUENCER & PARTNER MARKETING

4.1. Mandatory Disclosure: All influencers or affiliates working with Besary must clearly disclose their relationship using tags such as #Ad, #PaidPartnership, or #BesaryPartner, as per UAE National Media Council (NMC) guidelines. 4.2. Brand Integrity: Partners are prohibited from making health claims or performance guarantees not explicitly approved by the Besary/Zambeel documentation. 4.3. Inquiry Routing: All partnership and influencer inquiries are managed exclusively by Udjat UAE (https://udjat.ae). Besary is not liable for unauthorized agreements made outside of the Udjat UAE management framework.

5. INTELLECTUAL PROPERTY IN ADS

5.1. Copyrighted Assets: All cinematic visuals, 8K resolution imagery, and high-fidelity media used in Besary ads are the property of Besary/Zambeel. 5.2. Prohibited Comparisons: Competitor-comparison advertising must be factual and non-disparaging, adhering to the UAE’s fair competition laws.

6. PROHIBITED CONTENT

Besary will never engage in or allow advertisements that contain:

  • Content that violates UAE public morals or Islamic values.
  • “Bait and switch” marketing tactics.
  • Unverified “before and after” claims for products where results vary by individual.

7. DISPUTES & REPORTING

7.1. Reporting Ads: If you believe a Besary advertisement is misleading or contains a technical error, please report the bug to Brightery (https://brightery.com). 7.2. Legal Indemnity: Users and third-party advertisers agree to indemnify Besary and its partners (Udjat UAE and Brightery) against any claims resulting from the user’s violation of these advertising standards.
