These Terms and Conditions (“Terms”) govern the relationship between Besary (“Company,” “we,” “us,” or “our”) and any person (“User,” “you,” or “your”) accessing the website https://besary.com (the “Site”) and purchasing products or services.
By using the Site, you provide your irrevocable acceptance of these Terms. If you do not agree to these Terms, you are prohibited from using the Site.
1. LEGAL FRAMEWORK & JURISDICTION
1.1. Governing Law: These Terms are governed by the Federal Laws of the United Arab Emirates and the local laws of the Emirate in which the Company is incorporated. 1.2. Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Courts of the United Arab Emirates. 1.3. Compliance: Users are responsible for compliance with all local laws applicable to their use of the Site.
2. REGISTRATION AND ACCOUNT SECURITY
2.1. Account Integrity: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 2.2. Accuracy of Information: You warrant that all information provided during registration or checkout is truthful, accurate, and current. The Company reserves the right to suspend accounts providing false data. 2.3. Unauthorized Access: You must notify us immediately of any unauthorized use of your account or any other breach of security.
3. TERMS OF SALE & PAYMENT
3.1. Order Acceptance: The receipt of an order number or email confirmation does not constitute the acceptance of an order. We reserve the right to refuse or cancel any order for reasons including product unavailability, errors in pricing, or suspicion of fraudulent activity. 3.2. Pricing Policy: Prices are displayed in AED. We reserve the right to adjust pricing at any time without prior notice. 3.3. Payment Methods: We accept payments through authorized UAE gateways. By submitting payment information, you represent that you have the legal right to use the selected payment method. 3.4. VAT: All prices are inclusive/exclusive of Value Added Tax (VAT) as per UAE Federal Decree-Law No. (8) of 2017.
4. COMPREHENSIVE RETURN & EXCHANGE POLICY
4.1. The 14-Day Rule: In accordance with Besary’s brand standards and UAE consumer guidelines, customers may request a return or exchange within a strict window of fourteen (14) calendar days starting from the exact time of purchase/delivery. 4.2. Eligibility Criteria: To qualify for a return or exchange, the product must be:
- In its original, unopened, and undamaged retail packaging.
- Unused, unwashed, and with all original tags/seals intact.
- Accompanied by the original tax invoice. 4.3. Exclusions: For health, hygiene, and safety reasons, certain categories (including but not limited to undergarments, earrings, or customized goods) are strictly non-returnable unless a manufacturing defect is proven. 4.4. Refund Process: Refunds will be processed through the original mode of payment. Please note that banks/payment gateways may take up to 10–14 business days to reflect the amount. 4.5. Shipping Costs: Original shipping fees are non-refundable. The customer is responsible for the cost of returning the item to our UAE facility unless the return is due to an error on our part (e.g., wrong item sent).
5. INTELLECTUAL PROPERTY & BRAND PROTECTION
5.1. Ownership: All content, including but not limited to logos, trademarks, text, high-resolution imagery, UI/UX design, and code, is the sole property of Besary. 5.2. Prohibited Use: Users are strictly prohibited from “scraping,” copying, republishing, or distributing any content from https://besary.com for commercial purposes without an express written license from the Company. 5.3. Brand Integrity: Any use of our trademarks or brand names in meta-tags, hidden text, or “ad-words” without our consent is a violation of UAE Intellectual Property laws and will be prosecuted.
6. LIMITATION OF LIABILITY & DISCLAIMERS
6.1. “As-Is” Basis: The Site and all products are provided on an “as-is” and “as-available” basis without any warranties, express or implied. 6.2. Damage Limitation: Under no circumstances shall Besary be liable for any direct, indirect, incidental, or consequential damages (including loss of profit or data) arising from your use of the Site or products purchased. 6.3. Total Liability Cap: Our total liability for any claim shall not exceed the amount actually paid by you for the specific product in question.
7. INDEMNIFICATION
7.1. You agree to indemnify, defend, and hold harmless Besary, its parent company, subsidiaries, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising from:
- Your breach of these Terms.
- Your violation of any law or the rights of a third party.
- Any activity related to your account.
8. FORCE MAJEURE
8.1. Besary shall not be held responsible for any delay or failure to perform its obligations (including delivery) if such delay is caused by events beyond our reasonable control, such as acts of God, war, civil unrest, pandemics, or disruptions in global logistics.
9. TERMINATION OF USE
9.1. We reserve the right to terminate your access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is detrimental to the Besary brand.
10. MODIFICATIONS
10.1. We reserve the right to update these Terms at any time. The “Last Updated” date at the top of the page will reflect the most recent changes. Your continued use of the Site following updates constitutes acceptance of the new Terms.

You agree to indemnify and hold harmless Besary, along with its partners Udjat UAE and Brightery, from any and all claims, damages, and expenses (including legal fees in the UAE) arising from your misuse of the Site, violation of these Terms, or infringement of any intellectual property rights owned by the Company or its designated partners.

13.1. Digital Communications: By using the Site, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this Site. 13.2. Legal Validity: You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
14. ENTIRE AGREEMENT
These Terms, including the specific 14-day return window and the routing of inquiries to Udjat and Brightery, constitute the entire agreement between you and Besary regarding the use of the Site. If any provision is found to be invalid by a UAE court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
